Terms of Service

1. Acceptance of Terms

By downloading, installing, or using CardioInsight ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

CardioInsight is a fitness application primarily designed for adult users (13+) that analyzes your workout data from Apple HealthKit to provide insights into your heart rate zones and training performance. The App helps you understand your fitness data and improve your training effectiveness.

Target Audience: CardioInsight is designed for serious runners, cyclists, and fitness enthusiasts who want to optimize their heart rate zone training. While younger users may use the app with parental supervision, the training methodologies and heart rate zone calculations are based on adult exercise physiology.

3. User Accounts and Data

3.1 Age Requirements and Restrictions

Primary Users (13+ years): CardioInsight is intended for users who are 13 years of age or older.

Users Under 13: Children under 13 may use CardioInsight only with explicit parental consent and supervision. Parents/guardians are responsible for:

• Providing consent for their child's use of the app
• Supervising all health and fitness activities
• Ensuring age-appropriate use of heart rate monitoring
• Consulting with pediatricians before starting any fitness tracking program
• Understanding that intensive heart rate zone training may not be appropriate for children

3.2 Technical Requirements

To use CardioInsight, you must:

• Have a compatible iOS device running iOS 18.5 or later
• Grant necessary permissions to access HealthKit data
• Have an Apple Watch or compatible heart rate monitoring device
• Provide accurate information when prompted

3.3 Data Responsibility

You (or your parent/guardian if under 18) are responsible for:

• The accuracy of your health data
• Keeping your device secure
• Regularly backing up your data
• Understanding that all data is stored locally on your device
• Ensuring appropriate medical supervision for fitness activities
• Monitoring heart rate data for any concerning patterns

4. Permitted Use

You may use CardioInsight for:

• Personal fitness tracking and analysis
• Monitoring your heart rate zones during workouts
• Viewing your workout history and progress
• Analyzing your training data

5. Prohibited Use

You may not:

• Use the App for any illegal purposes
• Attempt to reverse engineer or modify the App
• Use the App to harm others or violate their privacy
• Distribute malware or engage in any harmful activities
• Use the App for commercial purposes without authorization
• Share your access credentials with others

6. Medical and Health Disclaimers

6.1 Not Medical Advice

CardioInsight does not provide medical advice. All information and analysis provided by the App is for informational and educational purposes only. Always consult with a healthcare professional before:

• Starting any new exercise program
• Making significant changes to your training routine
• If you have any health concerns or conditions
• If you experience any unusual symptoms during exercise

6.2 Accuracy Disclaimer

While we strive for accuracy, we cannot guarantee that:

• Heart rate data from your device is completely accurate
• Our analysis perfectly reflects your actual fitness level
• The App will meet all your fitness tracking needs
• All features will work perfectly on all devices

6.3 Special Considerations for Minors

WARNING: Use of CardioInsight by individuals under 18 requires special consideration:

• Growth and Development: Children and teens are still developing, and adult fitness standards may not apply
• Heart Rate Variability: Youth heart rates can vary significantly and may not follow adult zone calculations
• Overexertion Risk: Young athletes may be more prone to overexertion or may not recognize warning signs
• Medical Supervision: Any fitness program for minors should involve healthcare professionals familiar with pediatric exercise physiology
• Parental Responsibility: Parents/guardians are fully responsible for determining age-appropriate use of heart rate training data

7. Intellectual Property

All content in CardioInsight, including but not limited to text, graphics, logos, button icons, images, audio clips, and software, is the property of CardioInsight or its licensors and is protected by copyright and other intellectual property laws.

8. Privacy

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information. By using the App, you agree to the collection and use of information in accordance with our Privacy Policy.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CARDIOINSIGHT AND ITS DEVELOPERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits or data
• Business interruption
• Personal injury resulting from use of the App
• Reliance on App data for medical decisions

10. Warranty Disclaimer

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy of data
• Uninterrupted service

11. Indemnification

You agree to indemnify and hold harmless CardioInsight and its developers from any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the App or violation of these Terms.

12. Termination

We may terminate or suspend your access to the App at any time, with or without cause, and with or without notice. You may also terminate your use of the App by deleting it from your device.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by updating the "Effective Date" and posting the revised Terms in the App. Your continued use of the App after such changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction where CardioInsight is developed, without regard to its conflict of law principles.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms constitute the entire agreement between you and CardioInsight regarding the use of the App and supersede all prior and contemporaneous agreements and understandings.
